What is negligence?

Negligence in Florida is if a person fails to act in a reasonable manner and causing a collision. For example, if another driver rear-ends you, there’s a presumption of negligence because that person caused the accident. Anytime a driver fails to act in a reasonable manner and causing the collision, whether it’s hitting you on the side of your vehicle, running a stop light or running a stop sign or rear-ending you, that constitutes negligence in the state of Florida.
