What if the cause of my Florida car accident is not clear?
There are many factors a debtor determine to see who is at fault or what portion that party may be at fault. Florida is a pure comparative negligence state and so you are allowed to recover whatever percentage of fault there is against the other driver, even if you’re partially at fault. Alternately, the case is determined by a jury and a jury would actually assess the percentage of liability for each party due to the collision.
