What if the cause of my Florida car accident is not clear?

There are many factors a debtor determine to see who is at fault or what portion that party may be at fault. Florida is a pure comparative negligence state and so you are allowed to recover whatever percentage of fault there is against the other driver, even if you’re partially at fault. Alternately, the case is determined by a jury and a jury would actually assess the percentage of liability for each party due to the collision. The factors that are considered and witness testimony and the damage to the car and, of course, the party’s own testimony. But you can always recover, at least to the extent of liability that’s determined on the part of the other driver. You can recover that percentage of your damages.
