What are subrogation rights?
Subrogation rights pertain to if a health insurance company pays your bills for an automobile accident, the health insurance company can then make a subrogation claim against any recovery you may have.
The reason for this that Florida is a no fault state. And so you are required to have your bills paid by your primary source, which is your automobile insurance. They will pay up to $10,000 of coverage. If you go through all of that coverage, then you will need to use your health insurance, if you have health insurance. In that case, the health insurance company will then become primary and pay your medical bills. But at the end of your case, if you have a settlement, the health insurance company will have subrogation rights, meaning they will get to get reimbursed out of your settlement.
